TERMS & CONDITIONS (PHOTOGRAPHY SERVICES)

1. Booking & Agreement

By booking services with AJ Sylvester Photography (“the Photographer”), the client agrees to these Terms & Conditions. A booking is considered confirmed only once a non-refundable booking fee has been received and written confirmation has been issued.

 

2. Booking Fee / Deposit

A non-refundable booking fee is required to secure all sessions, including weddings, events, family, maternity, and newborn photography.

• The booking fee is deducted from the final balance

• Dates are not reserved until payment is received

• Failure to pay within the agreed timeframe may result in the date being released

This fee covers administrative work, time allocation, and the loss of potential bookings.

 

3. Cancellations & Rescheduling

Client Cancellation

• The booking fee is strictly non-refundable under all circumstances

• Cancellations within 30 days of the session/wedding date may result in partial or full balance being payable depending on costs already incurred

Client Rescheduling

• One reschedule may be permitted at the Photographer’s discretion, subject to availability

• Short-notice rescheduling may incur additional fees

Photographer Cancellation

In the unlikely event of cancellation by the Photographer due to illness or unforeseen circumstances, all monies paid (including booking fee) will be refunded in full. The Photographer will make reasonable efforts to recommend a replacement photographer but cannot guarantee availability.

 

4. Weather & Outdoor Sessions

For outdoor sessions:

• Weather conditions are considered part of the photographic process

• Sessions may be rescheduled in unsafe or unsuitable conditions at the Photographer’s discretion

• No refunds are issued due to weather changes

 

5. Client Responsibilities

The client is responsible for:

• Arriving on time

• Ensuring all participants are present and ready

• Ensuring children are supervised at all times

• Communicating any special requirements in advance

Delays caused by the client may reduce session time without refund.

 

6. Image Delivery

• Final edited images are delivered via online gallery within an estimated timeframe provided at booking (typically 2–6 weeks depending on workload and season)

• Rush editing is not guaranteed unless agreed in writing

• Editing style is at the Photographer’s discretion in line with portfolio style

 

7. Image Use & Copyright

• Copyright remains with AJ Sylvester Photography at all times

• Clients receive personal-use licence only

• Images may not be altered, edited, or sold without permission

• The Photographer may use images for portfolio, website, social media, and marketing unless the client requests otherwise in writing before the session

 

8. Limitation of Liability

While every effort is made to provide a high-quality service, the Photographer is not liable for:

• Emotional or subjective dissatisfaction with style or artistic interpretation

• Loss of images due to technical failure, theft, or circumstances beyond control (reasonable backup procedures are in place)

• Injuries or accidents occurring during a session, except where caused by proven negligence

Liability is limited to the total amount paid for the service.

 

9. Fulfilment of Services

The Photographer agrees to deliver photography services as described at the time of booking. In the event of unavoidable circumstances affecting fulfilment, a reasonable alternative solution will be offered where possible, including rescheduling or partial refund if applicable.

 

10. Children & Newborn Safety

• Safety is the highest priority during newborn and children’s sessions

• The Photographer will not place children in unsafe positions or encourage unsafe posing

• Parents/guardians must remain present and responsible at all times

• The Photographer reserves the right to stop a session if safety concerns arise

 

11. Payments

• Full payment terms will be agreed at booking

• Final balances must be paid before or on the session date (unless otherwise agreed)

• Late payments may result in withholding of final images

 

12. Force Majeure

The Photographer is not liable for failure to perform services due to events beyond reasonable control including but not limited to: illness, accident, extreme weather, fire, technical failure, or government restrictions.
